The German federal state Schleswig-Holstein wants to change German constitution
The federal state government is planning a initiative at the federal council (Bundesrat) to protect "sexual identity" in Article 3 of the Basic Law
The federal state government of Schleswig-Holstein is planning to apply for an amendment to Article 3 of the Basic Law via a Bundesrat (federal council) initiative and to protect "sexual identity" in this article[1] . The reason was an incident at a queer youth centre in Lübeck. The whole process is an example of the strategies used to sacrifice women's and girls' rights for queer politics - including by conservative parties - and how one tax-funded hand washes the other. Girls and women need sex-based laws to be upheld!
Schleswig-Holstein is governed by a coalition of the CDU (conservatives) and the Greens. The Minister President is Daniel Günther (CDU). The initiative for the motion can be traced back to the FDP (liberals) Schleswig-Holstein - presumably to the former Deputy Prime Minister, Minister of Social Affairs and Economics of Schleswig-Holstein, Dr Heiner Garg. The SPD (social democrats) and SSW (a small regional party) had supported the FDP's demand and jointly submitted a motion[2]
What had happened in Lübeck?
"QwertZ Queer & Zentral" is a youth centre in Lübeck for minors aged 12 and over run by the Lambda association. According to media reports, the centre had been threatened by two men. They had rung the doorbell of the youth centre on the third floor and asked if they could use the toilet. After being told that there was no public toilet there, they said: "What kind of young people are these? We're looking for new jobs, we're butchers." Then they left . [3]
Moritz Griepentrog, regional director of the Lambda Nord association and employee of the youth centre, assessed this as a "queer-hostile death threat" and called the police via the emergency number. The police initially saw no initial suspicion of a criminal offence and were overloaded. It was agreed that a patrol car would be sent if the men turned up again. After the management of the youth centre called a second time without the men appearing again, a patrol car was nevertheless sent to record the incident.
Griepentrog explained to Lübecker Nachrichten that "in the children's and youth group for young LGBTIQ* (lesbian, gay, bisexual, trans*, inter* and queers), there are also people who have not yet come out, who are not sure whether they want to tell their parents, for example, and need a safe space". "If the safe space is no longer safe, then we'll have problems here."
Griepentrog calls for "regular patrols of the youth centre by queer-sensitive officers, faster response times in the event of queer-sensitive attacks and police participation in a round table on the safety of the queer community in Lübeck".
Political consequences
Jasper Balke, spokesperson for the Bündnis 90/Die Grünen (The Greens) parliamentary group in the state parliament, picked up on this incident and welcomed "the renewal of the Bundesrat initiative to include the protection of sexual identity in Section 3, Paragraph 3 of our federal constitution". He emphasised that the state parliament in Schleswig-Holstein is the only one that can still achieve unanimity on such an issue. "Especially in view of the election results for the Bundestag elections, the thought of the high approval ratings for the far right sends shivers down my spine.[4]”
The CDU bowed to the plan and Marion Schiefer - responsible for Home Affairs and Law, Justice, Prison System, Victim Protection, Protection of the Constitution, Extremism - declared "in February 2025, the realisation could also prevail that the majority for constitutional change, as far and as long as one has it, should be used to give this legal self-evidence the necessary legal stability against a possible interplay of social and political forces. Keyword: resilience. Keyword: preserving what has been achieved. I hope that this legal policy realisation will prevail. Hence our own Federal Council initiative."
Schiefer refers to a quote from Dr Heiner Garg (FDP): "It is not those who demand equal rights who must justify the fact that they demand them, but those who still deny these rights must explain why they still do so today."
Dr Heiner Garg is currently the spokesperson for social affairs, health, family, daycare, youth, senior citizens, addiction and Europe in the state parliament of Schleswig-Holstein and has been campaigning for LSB rights for many years. He also commented on the incident in the state parliament[5] . As he signed the motion by the FDP, SPD and SSW, it can be assumed that he initiated it. Among other things, this motion also calls for the inclusion of sexual identity in the state constitution of Schleswig-Holstein. Both proposals are supported by the LSVD association.[6]
Powerful players in the background here are LSVD e.V. and Lambda e.V. - both nationally organised associations that benefit extensively from taxpayers' money. The FDP in particular is taking the initiative. More on this later.
Mr Garg was also the former Minister of Social Affairs in Schleswig-Holstein. More on how this affected girls' work below.
A decades-old project that will not be abandoned:
Sexual identity in the Basic Law
For many years, queer and trans activists have been fighting for the amendment of Article 3 of the German Basic Law and the protection of “sexual and gender identity”. The CDU/CSU and FDP had already prevented a similar initiative in 2010 by the Greens, Left Party and SPD [7]
In recent years, various argumentation strategies have been used to push through this plan. Among other things, the persecution of gays under National Socialism is used as an argument.
In 2021, for example, the anti-discrimination commissioner of the German government – Ferda Ataman – made this demand on the occasion of Holocaust Remembrance Day[8] . A second, more recent argument is that the growing popularity of the right-wing party AfD increases the likelihood that marriage for gays will be abolished again.
The argumentation is mainly based on the protection of homosexuals. At this point, it should be noted that many gay people now say that they are voting for the AfD because they by the no longer feel represented of the Greens, FDP and SPDqueer policies [9] . The AfD therefore specifically targeted gay people for the Hamburg 2025 parliamentary elections.
Since the discrimination and endangerment of homosexuals is used as justification for an amendment to the Basic Law, one would have to demand the protection of sexual orientation. Instead, however, they want to protect the unclear concept of “sexual and gender identity", which is open to arbitrary interpretation. Legal experts explain that homosexuals are already protected under of the Basic Law Article 3, paragraph 1 anyway and that there is no need to explicitly mention this[10] . Arnd Diringer: "The "protection sought" is "already guaranteed in Article 3, Paragraph 1 of the Basic Law". According to the recommendation of the Legal Affairs Committee, the FDP correctly explained this in 2011."
Feminists demand: Article 3 should not be watered down
Article 3 of the Basic Law guarantees equal rights for women, among other things. Paragraph 2 was fought for by Dr Elisabeth Selbert. [11]
It reads:
(1) All people are equal before the law.
(2) Men and women shall have equal rights. The state shall promote the actual realisation of equal rights for women and men and work towards the elimination of existing disadvantages.
(3) No one may be discriminated against or favoured because of their gender, origin, race, language, homeland and origin, faith, religious or political views. No one may be disadvantaged because of their disability.
In the meantime, trans and queer activists have expanded their demands and also want to amend Article 2, paragraph 1.
This reads:
(1) Everyone has the right to the free development of his personality, provided that he does not infringe the rights of others and does not violate the constitutional order or the moral law.
In particular, this involves the deletion of the second part, which restricts the free development of the personality through the rights of others and social norms and customs.
Just how problematic it is to protect an unclear term such as "sexual identity" in the Basic Law is shown by the fact that paedophile activists such as Dieter Gieseking (Krumme 13) have shared this idea and demand for years. The paedophile expressly welcomes this initiative. Even if queer and trans activists claim that paedophilia is not meant by "sexual identity", Gieseking explains that he will go all the way to the Constitutional Court to enforce the protection of paedophilia as a sexual identity. Zoophilia and many other sexual deviancies and paraphilias can also be categorised as sexual identity.
In combination with an amendment to Article 2, it would therefore be a constitutionally protected right to confront everyone with their own sexual peculiarities and perversions and to live them out in public.
I myself and others have written several times about [12] why this demand should not be granted under any circumstances. Nevertheless, queer activists and their tax-funded organisations are able to convince more and more politicians. They are primarily targeting CDU-led state governments in order to obviously increase the pressure on the CDU/CSU as a whole.
Before the Bundestag elections, the LSVD recently organised a campaign under the motto "Strengthening charity. Promote cohesion." with the aim of convincing the CDU/CSU . [13]
A two-thirds majority in the Bundestag and Bundesrat is required to amend the Basic Law. CDU politicians and state premiers who have openly spoken out in favour of this amendment to the Basic Law are already: Daniel Günther, Norbert Röttgen, Hendrik Wüst, Kai Wegener, Jan-Marco Luczak, Tobias Hans and Stefan Kaufmann, who is, however, retiring from the Bundestag.
The Greens, the SPD, the FDP and the Left Party included the demand in their programme for the Bundestag elections. Only the CDU/CSU is cautious on this point.
In addition to the danger that any sexual deviance would be protected by this amendment to the Basic Law, sex-based women's rights would also be jeopardised.
Misogynistic laws such as the Self-Determination Act, which allows any man to declare himself a woman and thus degrades women to the identity of a man, would hardly be able to be challenged under the German constitution if sexual identity were protected. Protection on the basis of sexual identity cancels out protection on the basis of sex.
The second part of paragraph 1 of Article 2 is also decisive here, because the rights of girls and women are violated by the Self-Determination Act. The moral law also plays a role, even if the current LSVD campaign wants to portray it as an outdated relict from the 1950s. Individual freedom should continue to end where actions violate the fundamental moral rules that are considered indispensable in society. This is because it protects the common good and the rights of others from excessive or harmful behaviour.
Specifically, girls and women should continue to be protected if a man wants to involve them in the public display of a sexual fetish without their consent. It should not be a man's fundamental and human right to live out his fetish in public because this violates the rights of children, girls and women and contravenes moral rules.
In the basement of queer politics in Schleswig-Holstein
Back to Schleswig-Holstein: Here - as introduced above - pressure was exerted on the CDU to submit an application for an amendment to the constitution because of an incident in a queer youth centre run by Lambda e.V.. Such precedents are often used to drive the project forward.
Moritz Griepentrog is the regional director of Lambda Nord. Lambda e.V. is a powerful nationwide organisation. He is also a member of the working group on recommendations for dealing with the challenges faced by non-binary and trans* young people [14][15] .
This working group, which is based in the Ministry of Social Affairs, was set up by the Green Party's Aminata Touré - Minister for Social Affairs, Youth, Family, Senior Citizens, Integration and Equality. Other members are Haki e.V., the "Echte Vielfalt" office and the LSVD.
The LSVD
At the time this working group started, male trans activist Stephanie Hochsprung was on the LSVD board. He should take part in the working group on behalf of LSVD to evaluate plans for yout work, although he is just a self-employed network engineer. Hochsprung was also a leading state association member of LiSL[16] - the queer working group of the FDP. He was LiSL board member for LiSL North (Schleswig-Holstein and Mecklenburg-Western Pomerania). Hochsprung had made public misogynistic comments on Twitter in particular and commented on and shared sexual and pornographic content[17] . When this due to reports by Nius became public [18] , he lost his position on the LSVD board. However, he was still on the LiSL board for a few months and was also seen on a podium at a LiSL event alongside Minister of Justice Marco Buschmann and Hirschfeld Foundation President Helmut Metzner.
The LSVD federal association now calls itself the "Queer Diversity Association" and represents the interests and concerns of lesbian, gay, bisexual, trans*, intersex and other queer people (LGBTIQ*")" .[19] The LSVD has been lobbying for sexual identity in the Basic Law for many years. The current campaign is not only calling for Article 3 to be amended, but also Article 2[20] . The board is male-dominated. Two trans activists who are active on the board have attracted attention several times in the past due to their misogynistic statements.
The "Echte Vielfalt" (“genuine diversity”) office
The third member of the working group is the "Echte Vielfalt" office[21] . It is headed by Daniel Lembke-Peters and organises networking among various LGBTQ groups in Schleswig-Holstein and the "Real Diversity Round Table". The office also lobbies politically - including outside Schleswig-Holstein. At the same time, it is supported and financed by the Ministry of Aminata Touré.
"Genuine diversity" is the motto of the action plan for the acceptance of diverse sexual identities in the state of Schleswig-Holstein. The action plan has been in place since 2014 following a decision by the state parliament[22] . The website echte-vielfalt.de has been operated by the German Institute for the Social Economy (DISW) since 2021. [23]The DISW is responsible for the operation, ongoing updating and editing of the website. DISW is in turn funded by the Ministry of Social Affairs, Health, Youth, Family and Senior Citizens of the State of Schleswig-Holstein[24] . On its website, the DISW states that it is "a non-profit organisation with the purpose of supporting social service providers through research, development, consulting, transfer and qualification[25] ."
The "Flensbunt" youth centre also operates under the umbrella of "Echte Vielfalt"in Flensburg[26]. Among other things, this centre offers advice for parents whose children are coming out. The counsellor in the Trans & Inter self-help group is Bundesverband Trans member Markus Marielle Hirtz[27] . The centre is run by Andreas Witolla, who is also part of the Aidshilfe Nordfriesland team[28] . In 2024, the association vielfalt.SH e.V. was founded, which now supports the Flensburg Aidshilfe and Flensbunt, SCHLAU Flensburg, the queer youth group Regenbogenaxolotl and is the organiser and cooperation partner of the queer party SL-Disco, the Flensburg Rainbow Days, the Queer Film Night and the CSD in Flensburg.
Haki e.V.
The office of the ‘Echte Vielfalt’ project is run by the fourth member of the working group: Haki e.V. Daniel Lembke-Peters is not only head of the ‘Echte Vielfalt’ office, but also a member of the board of Haki e.V.
Haki e.V. is a "non-profit organisation in the field of emancipation of gender diversity, same-sex lifestyles and diverse sexual orientations with a state-wide offer for Schleswig-Holstein as well as offers with a focus in the state capital Kiel[29] ." Like Lambda, Haki offers the SCHLAU programme for schools. Haki's programme also includes self-help, counselling and leisure activities. Haki has a meeting place in Kiel - the Haki Centre. Haki is also an independent youth welfare organisation that is eligible for funding. Haki is also involved at a national level in many umbrella and professional organisations such as the Federal Trans Association[30] . Haki has 170 members and claims to be the largest LGB organisation in Schleswig-Holstein[31] . The association is supported by the Ministry of Mrs Tourè of the City of Kiel and the Paritätischer Verband Schleswig-Holstein. The board of Haki also includes a man who has declared himself a woman.

Lambda e.V.
Lambda e.V. is a Germany-wide organisation with 6 regional associations in Baden-Württemberg, Bavaria, Berlin-Brandenburg, Central Germany, Lower Saxony-Bremen and Northern Germany. According to Lambda Bundesverband, the regional associations are self-organised[32] . Lambda provides peer counselling for minors - i.e. adult lay people advise young people.
The association came under public scrutiny because one issue of its magazine “OUT” introduced sexual deviancies such as BDSM, nappy fetishism and ageplay to young people [33][34] . The magazine is designed by young people and openly accessible to minors on the Lambda website. The BDSM issue has since been taken offline. However, the current issue contains, for example, an article on how to obtain and take opposite-sex hormones independently ("DIY") and without the supervision of doctors in order to physically simulate a sex change.[35]
Lambda also took part in a project organised by the German Federal Youth Council[36] for "queer-sensitive youth travel" and published an FAQ on the subject. Here, mixed-sex accommodation is advocated so as not to exclude ‘trans’ and ‘non-binary’ young people. The FAQ also includes instructions on how to re-signpost single-sex toilets. The FAQ even explains the law on sexual offences to show what is possible for minors.[37]
Queer politics is therefore repeating serious mistakes - especially when it comes to protecting girls - that were already promoted by Helmut Kentler and committed in the form of a supposedly progressive youth policy that allows young people to decide for themselves which sex they share a tent with [38]. It is obvious that girls in particular are at risk here if, for example, they do not dare to speak out against a boy in their dormitory – especially if they are told that not accepting him is queer- or transphobic. The consequences of a possible pregnancy are also serious for girls. The issue of protecting girls, taking into account the fact that girls generally do not dare to resist and say ‘no’ in a group, is not really addressed in the FAQ.
Perfect networking and public funding
The situation in Schleswig-Holstein alone shows that queer organisations are now perfectly networked at state and national level and have access to lavish state and federal funding. Unfortunately, only the federal funds can be researched in a largely transparent manner via the lobby register of the Bundestag. Lambda e.V., for example, received EUR 460,000 in 2023 from the Federal Ministry for Family Affairs [39] . In Schleswig-Holstein, Lambda Nord is funded by the Hanseatic City of Lübeck and the Schleswig-Holstein Ministry of Social Affairs.
The LSVD received EUR 820,000 in 2023 from the public purse. Some of its board members are employed by members of the Bundestag and can exert direct influence there.[40]
Dilution of girls' work and protection of girls through queer politics in Schleswig-Holstein
Queer politics leads to sex-specific concerns of women and girls being neglected - as is also the case in Schleswig-Holstein.
Girls' work in Schleswig-Holstein is only carried out with a gender star. The LAG Mädchen, for example, is oriented towards "queer-feminist and intersectional perspectives" and uses the gender star "to represent the diversity of gender positioning and to emphasise the changeability of gender".
However, a targeted approach to girls' rights and protection – including work with girls – must take sex as its basis, because girls are discriminated against on the basis of their sex and experience and suffer specific physical experiences, oppression and violence that only female children and young females share.
In the meantime, girls' work seems to be only a marginal phenomenon under "queer child and youth work" in the Green-led Ministry of Social Affairs in Schleswig-Holstein. In a report to the Social Affairs Committee, Aminata Tourè summarises the "Mädchen*fest Bunt. Loud. Mach mit" and the "Fachtag queersensible Mädchen*arbeit" only under the heading "queer child and youth work in S-H" . [41]
The 2019 ‘Recommendations for work with girls* and boys* in Schleswig-Holstein’ by the Ministry of Social Affairs under Social Minister Heiner Garg also focus on ‘intersectionality’ and ‘queer-feminist work with girls*’.
“With the reception of queer-feminist theories, it becomes clear that the category of girls* cannot be thought of as an unambiguous and consistent category (cf. Schmitz 2016, p. 177f). For girls’ work, this means broadening the perspective and increasingly focusing on trans* young people as a target group. The conceptual considerations for this can be understood as a further development of the previous principles of girls' work. For example, girls' rooms can be used as spaces for experimenting with diverse gender and sexual identities (see Pohlkamp/Rauw 2010, p. 23f). This makes it possible to counteract exclusions that are based on the norm of gender binary. To do this, educators should reflect on their own gender constructions and “reveal the performative character of gender”.
Also, ONLY in the case of girls is it discussed that their groups should also be led by "trans* professionals" instead of primarily by women, as has been the case up to now.
In case of the ‘Jungen*arbeit’ (working with boys) the need to take queer feminist aspects into account is mentioned nowhere. While it is particularly emphasised in the case of work with girls that this should also be open to boys who identify as girls, the focus in the case of work with boys is that this works particularly well when boys are among themselves.
These rules of the state of Schleswig-Holstein went so far as to allow a male – Laura Schulze-Kölln[42] - to run a girls' meeting place in Husum for pro familia. Regarding his motivation, he says: “The girls’ meeting place is important to me because it gives me the opportunity to try myself out.” He has since moved to a children's shelter in Neumünster due to discussions and protests. Schulze-Kölln sees himself as a victim of transphobia [43].
Laws on the protection of women and girls must remain conceptually clear!
Previous amendments to German laws show that the protection of sex-based laws for girls' and women's is important.
Like LAMBDA and the German Youth Council, LAG Mädchenarbeit refers to Section 9(3) of the German Child and Youth Welfare Act (SGB VIII)[44] , which was amended under massive pressure from trans activists and trans activist lawyers and included the fantasy genders "transgender, non-binary and intersex" in German legislation for the first time. This example makes it clear once again that any watering down of laws that previously secured sex-based girls' and women's rights leads to girls and women being disadvantaged and jeopardised (see youth camps).
It is further proof that "sexual identity" must not be included in Article 3 of the Basic Law under any circumstances.
As I am writing this article, paedophile activist Dieter Gieseking is gloating in his blog Krumme 13[45] that in the public broadcaster NDR Prof. Dr Christian Huchzermeier explains that paedophilia can be equated with sexual orientation and is a "natural predisposition" that is nobody's fault. The storyline of the NDR report[46] is a "poor" father who has allegedly successfully fought against his "inclination" with the controversial programme "Kein Täter werden" (Don't become a perpetrator).
Before he started the programme, he had masturbated in the clothes of a guest child during an overnight stay. His wife found the item of clothing and then imposed the condition that he should go through the programme, otherwise she would divorce him.
Gieseking notes that Huchzermeier has plenty of books on his shelf that Krumme 13 also recommends. Gieseking: "Paedophiles who have read the above literature would never think of going to therapy. And THAT is the vast majority of the paedophile scene in Germany and worldwide..."
Huchzermeier works at the University Medical Centre Schleswig-Holstein and heads the "Kein Täter werden" prevention network in Kiel.
Paedocriminals use unclear terms such as "sexual identity" to legitimise and normalise child abuse. Another reason why this term must never be included in Article 3 of the German Basic Law!
